Intellectual property can be in different forms, including scientific invention, art, technical projects, or literary creation. There are certain laws and stipulations that govern each type of intellectual property. Generating and executing ideas can be lucrative, but if you fail to protect them, someone can infringe upon them, which can have unfavorable consequences for an individual or business. What Are Intellectual Property Rights?

All rights associated with intellectual property granted to a person, company, or entity are known as intellectual property rights. These rights protect the owner’s intangible assets or intellectual property against infringement, abuse, or misuse. Only the assignee or owner has exclusive rights to utilize their creation for a specific time period. The following are four forms of intellectual property rights:     

Patent law

A patent gives the inventors the exclusive rights to utilize, modify, and sell their inventions or products. Patent law prevents other people from selling their product or creating an identical product. Any individual or organization who wants to market your patent-protected invention or products would have to obtain your permission. 

Generally, once you obtain a patent, it will last for 20 years from the time of filing. You can apply for a patent at the USPTO (United States Patent and Trademark Office), but it is important to remember that only some products or inventions can be patented. For example, surgical procedures, scientific discoveries, business methods, or mathematical methods are examples of inventions that cannot be patented.  

All entertainment, literary, and artistic projects, including paintings, films, and books, are covered under copyright law. This law provides creators and authors exclusive rights to their content, preventing others from duplicating, selling, or modifying it. Anyone who wants to use a copyrighted work should get the creator’s permission through a licensing agreement according to copyright law. The time frame for copyright law depends on several factors, including when the work was published. 

Trademark law

Insignias, phrases, or symbols can be trademarked to protect the visual aspects of a brand and legally distinguish it from other brands. Under trademark law, a mark can only be eligible for a trademark if the design is distinguished and created for use in commerce. Trademark law prevents improper use and dilution of trademarks. In addition, this law provides exclusive rights to the trademark owner, which can be a company, estate, sole proprietor, or individual. 

Trade secrets

A trade secret is a company’s practice, service, formula, or items that it creates to gain a competitive advantage and economic benefit. These are typically a result of the company’s development and research. Common examples of trade secrets include recipes, designs, patterns, proprietary processes, and formulas. 

Unlike patents and other types of intellectual property rights, no procedural formalities are required to protect trade secrets. They can be protected for as long as another party legally acquires them from the owner or if the trade secret is disclosed to the public.
