About The Job:
We are seeking a highly skilled and experienced Legal Collection Head with expertise in Litigation and Arbitration to lead our legal collections team. This individual will manage and oversee all legal matters related to debt recovery, including pursuing legal action in court, representing the company in arbitration proceedings, and ensuring compliance with relevant laws. The role requires strong leadership, strategic thinking, and a deep understanding of legal proceedings in both collections and dispute resolution.
• Strategic Management:
• Lead, develop, and manage the collections team, ensuring that all legal collection activities are executed in a timely, effective, and compliant manner.
• Create and implement strategies for efficient debt recovery, leveraging both litigation and arbitration as appropriate.
• Provide guidance on the legal and operational aspects of collections, advising senior management on the best course of action.
• Litigation and Arbitration:
• Oversee and manage legal actions involving collections, including the preparation, filing, and representation of claims in court.
• Coordinate and manage arbitration processes, ensuring timely responses and resolution of disputes.
• Work closely with external counsel when required, providing oversight of legal proceedings and managing relationships with law firms.
• Contract Review and Compliance:
• Review and analyze contracts, agreements, and related documents to identify opportunities for legal action in collections and potential risks.
• Ensure all collections activities comply with relevant laws, regulations, and internal policies.
• Stay up to date on legal changes and trends in collections, litigation, and arbitration.
• Reporting and Documentation:
• Maintain accurate and up-to-date records of all legal actions, decisions, settlements, and judgments.
• Provide regular reports on the status of legal collections and arbitration matters to senior management.
• Manage and oversee the legal budget for collections and litigation activities, ensuring cost-efficiency.
• Negotiation:
• Lead negotiations with debtors, ensuring favorable settlements or payment arrangements when litigation is not immediately required.
• Represent the organization in mediation or settlement discussions to resolve disputes without the need for prolonged legal proceedings.
• Collaboration:
• Collaborate with internal departments such as finance, risk management, and compliance to coordinate collection efforts.
• Work closely with senior executives to define organizational goals related to legal collections and debt recovery.
Education
• LLB degree from an accredited law school preferred.
• Bar membership or appropriate legal qualification for jurisdiction.
Experience
• 10+ years of experience in legal collections, with a proven track record in litigation and arbitration.
• Strong experience managing and leading a legal team, preferably in a corporate or financial services environment.
• In-depth understanding of debt collection laws, arbitration rules, and legal frameworks.
